Default 2005 Civic Rear Bumper Fix Cost?

I was driving back home yesterday night and someone from back hit my car. The rear bumper is damaged, see the picture for more details. The left side crack and fallen apart from the top.

I have 2 questions.

- How much will it cost to get the bumper replaced?
- The guy hit me has a ordinary insurance (Apollo Casualty Company), reputation is really bad. Should i claim to them or mine?

Please someone here can help me. I have no knowledge over it and what i can see from my research that it can cost from 350-600. Some also mentioned it can go upto 1000. I have no clue.
