Yeah it should work. I have a 94 lude si which comes with the h23 and it was swapped to an h22. The car passed emissions testing for the person who i bought it from although where i live it is just a visual inspecion. just make sure it has a decent exhaust.

if you want to make sure it passes emissions make sure parts are carb legal, if they are then it will pass nationwide since cali has the strictest emissions laws. the only swapping the engine wouldnt be legal is if the engine is reported stolen, but it would be a lot of trouble for cops to find all the codes on the engine to run a record check (always the possibility though)
