So i just got a new 08 honda fit sport on June 25 2008. Well on thur 7/3/08 a guy from the dealership tried to get in contact with me. Well i was busy and couldnt talk with him, so in Sunday he tried again and was telling me that the bank approves me, but not the amount to be financed. So they said that i have 3 options...1)give them 3 or 4 thousand more dol(which i def dont have!!!) 2)geta co signer (no one will!!) or 3) give back the car, and get my old one back...well with my old one they whole saled it out the next day...they had 21 days according to the contract to cancel the sale...but i have no idea why they are doing this...my old car i still owed 2900 on it and it got traded in for 2500 400 more dol were added on. can some one please explain to me, i dont feel like talking to the guy who keeps calling me b/c hes soo rude and if they take my car, they are going to have the worse end of the stick b/c i drive alot for work, and i almost have 1000 mi on it, and me very unhappy!

When you signed your contract, there was fine print saying that the contract was only valid if the financing was approved, so the dealership has the right to demand that you bring back the car or pay the difference. Often a dealership will assume that a bank will give you a loan, then for whatever reason the bank refuses the loan. The real problem is that they have already sold your car. You need to sit down (in person) with the finance manager of the dealership and work something out. Obviously paying $4,000 more is not an option, so try to explain to them that the vehicle already has 1,000 miles on it. If the finance manager is unable to help, ask to speak to the general manager. The key here is trying to convince them to help you out, so be nice to them and ask for help. Some negotiation points: They can give you more for your tradeThey can sell you the Fit for less moneyThey can work harder to get the bank to finance youIf talking to them gets you no where, you're out of luck unless they can find a less expensive Fit to sell you. You can also try to get the vehicle financed on your own with a local credit union or your own personal bank.

Hey they gave you 2500 for your old car, they added 400 to settle the 2900. They are adding the 400 to your current financing, (your still paying the 400 in your new payment). If these are your only options and you cant make good on any of them, at least you got to ride 1000 miles for only gas. Your between a rock and a hard place, no easy way out, good luck with your decision.

they tried this same thing with my son and his wife. he told them to make it work or he was going to sue AND turn in there company in for improper practices as a state licensed dealer. he did call washington state dept of dealer licenses and make a complaint. they ende up making everything work and upheld there part of the bargain. he still has his truck. hope this helps

I don't know what state you live in, but I believe to unwind the deal, they must make you whole again. That is, you came in with a car and they must return the car or pay the agreed trade-in amount. Hopefully, the contract has the additional $400 they "gave" you as a trade-in. They'll owe you the $2900.00. The problem is, there may be fees associated with turning the car back in. It's probably worth $75 to $150 to spend an hour with a lawyer to review the contract. Do not be talked into filing a lawsuit. It's unnecessary. You have to talk to them. It's not going to get better on it's own. Be calm, nice and business like.

I would say screw them and return the car. It is in your favor because they want to sell you the car if they can. I think they are playing with you because you do not have much experience in this matter. if you do return the car, you must get equal value for your old car - If they refuse to pay the fair amount, you have the right to take this matter to small claims court and settle it through a judge (which does not cost you much because lawyer is not involved in this)
