I decide to buy a brand new 2006 civic hybrid, it's been 3 months since i signed the contract and the salesperson promised me (not in writing) that it would take up to 2 months, hey also stated that in oder to get the paperwork going they needed at least $1,500 downpymnt, meanwhile they would let me have a loaner, So i got a loaner, didn't signed no paperwork ot nothing to get the loaner.I kept on calling them at least once a week ever since day one to know when my new car was arriving.Now 3 months have passed and NOTHING yet! i'm still driving the loaner but i'm tired of wating for my new car, i went in yesterday and talk to the salesperson and he said he would't have a problem giving me the $1,500 back.So today i went in thinking i was gonna give them back the loaner and get my monay back and that would be the end of the deal. but gues what???!!! they want to keep the downpaymnt for the use of the loaner. That was never the agreement that we had. WHAT CAN I DO??

You need to talk to an attorney.But it sounds like you do not have to give them any money for the use of the loaner. If there was no agreement signed about the terms of you using the loaner car, you are probably in the clear. You should forget the salesperson at this point and go straight to the sales manager. If nothing out of him, go above him to the general manager or owner of the dealership and let them know the situation.

i agree, no contract linking the downpayment to the loaner they have no leg to stand on to keep your money on that issue.Remember, an oral contract is just as binding as a written one. Just harder to prove. The salesman said "2 months" , and 3 months is probable long enough to be in violation of that oral contract.Just my humble opinion.

try to talk to the regional manager of Honda. Do get a lawyer if nothing works out. The thing is, a lawyer might put u down more than 1500, and if u lose the case, that'll be a double whammy. Try to c if u guys could compromise. As a last resort before getting a lawyer, try to contact a local newspaper or local TV news channel. Bad PR is a big "NO NO" for smart companies. check to c if a contract is not fulfilled within a period, can it become null and void? Read the contract carefully.

So lets see, you gave them a down payment of 1500, they loaned you a car as a gesture of good faith. You changed your mind because your car is taking too long. So you drove a car for 3 months with out any payment or insurance costs and now you want your money back? WA WA stop crying about the 1500. They deserve to keep the money. Lets see:3months of car payments $1200.3 Months of Insurance $450.Total $1650. What are you going to do? Fight them for the $1500 then start another 3 month wait at another dealership? And then expect the first dealership (who I'm sure is closer to your house) to service your vehicle under warranty?Time to Stand Up and Grow Up!
