Default 2001 Honda Civic airbags didn't deploy?

in 2011, we bought a used 2001 Honda Civic(200,000+ miles on it).

Just yesterday my sister was in a car accident and the air bags did not deploy. There was pretty serious damage to the passenger side and the passenger just had a broken rib or two and my sister only got a few bruises. But what really got to me was that in that serious of an accident, the air bags did not deploy.

I searched online and noticed there as a recall for 2001 Honda Civics due to the airbags deploying too fast.. kind of ironic because the speed of the airbags in this crash was clocked in at about... 0.

The guy we bought it from didn't inform us of any recalls(That I know of, my Uncle bought it for her but I doubt he'd let her drive it if he found anything wrong with it since he is a mechanic and owns his own shop)

So what do I do? Is there a lawsuit? I know my sister didn't suffer any major injury, but it is still terrifying to realize that she has been driving in this car for over a year with faulty airbags.

Clearly someone is at fault here. Whether it be the original owner or Honda themselves.

What do you think we should do? I don't think her insurance will cover it because I think she only has the state minimum.

I want to clarify that I am not looking for money here. I just want the bastard whose responsible for this to know he can't get away with selling a faulty car. I don't know the exact speed of impact, but the windows shattered on the passenger side, it knocked the door handle off the drivers side(some how) and the lock on the inside of the car on the passenger side flew off. So it must have been a good enough speed to cause that damage. I would assume normal cars would have deployed airbags.

The vehicle was fully inspected by an authorized mechanic.

And the only recall on air bags for this model is that it inflates too much and ruptures and metal fragments can pass through the air bag.

Both of which, the air bags actually have to deploy in order to be a problem

I would appreciate it if you take your snark little remarks back to the preschool playground you came from.

first ty god they came out safe. realize airbags are triggered. sometimes it happens because of speed or point of impact, or a faulty system the only lotto they won is you get to hug em tomorrow!

edit* i feel you man! its the nature of the beast. if it wasnt a direct frontal impact(remember i touched on this, as well as speed) there is no guarantee the airbags deploy, or are needed. nothing could help my daughter and yes you have every right to be pissed.

The mechanical state of a vehicle you own and drive is 100% your responsibility. You also had a chance to bring the car to an authorized Honda repair facility to make sure all the recalls and technical bulletins were up to date. Yeah, everybody is at fault here except you.......

side impact or offset side impact may not trigger the threshold for the airbags, no serious injury resulted from this accident, so what is the issue you have?
