When the lights go out I toggle the switch to get it back on' sometimes they come on and sometimes not. The side marker lights work ok, the head lights go out.

I had that a problem with my Legend a couple years ago. It turned out that the stalk itself was bad and that the low beams were too high of wattage for the car. So you might want to see a mechanic. I think it might have cost me about 200 dollars to replace the stalk. If you have any more questions ask the guys on www.acura-legend.com, they know their stuff. As I'm sure you know, the low beam stays on in the legend with the high beam, so no to C7S's answer.
